Important Ruling By Federal Administrative Law Judge On The Use of The NWS Heat Index Chart When OSHA Issues Citations

Both Federal OSHA and Cal/OSHA have used the NWS (National Weather Service) Heat Index Chart as evidence for the seriousness of exposure to heat illness by workers. A Federal ALJ advised that there was no scientific evidence as to how the Chart categorizes the seriousness of exposure. This is a victory for employers! While the ruling was not precedent setting, and is under a Federal OSHA citation; CALPASC members should consider using this ruling to push back on Cal/OSHA's beliefs on the validity of the Chart.
