A Positive CA Supreme Court Ruling For Incentive Pay Programs

On June 29, 2020 the Supreme Court published their decision in Oman v. Delta Air Lines. In the ruling, the Justices approved that incentive pay programs can be legal in California, but have to be carefully laid out. CALPASC member attorney Kyle Kring of Kring & Chung is preparing an overview of the decision; and we will forward it to you when he releases it. We thank Kyle for his efforts on our behalf.

This important ruling also paves the way for the state Supreme Court to review the Certified Tire and Service Center Wage and Hour Cases. They were waiting to issue Oman v. Delta first. The Certified appellate decision also approved of a specific type of incentive pay program. CALPASC members need to know and understand the rules that need to be followed for an incentive pay program to be legal in California.
