Insurance Commissioner Lara Approves WCIRB COVID-19 Proposal

As we have previously alerted, the WCIRB proposed three changes to workers' compensation insurance regulations. The pages reference the WCIRB regulatory proposal to the Commissioner, linked below.  

  1. Eliminating workers' compensation claims that arise directly from a COVID-19 diagnosis, from the employers future Experience Modification Calculations. You can see the final verbiage on page 14 of the document.
  2. Eliminating payroll used in workers' compensation premium calculations for employees who are being paid, either through the emergency Federal Paid Sick Leave, or Paid Family leave, or the employer keeping that employee on the payroll; but having no duties of any kind. You can see the final verbiage on page 8 of the document.
  3. Allowing an individual employee to be classified under Clerical Office Employees-8810; if they are temporarily working in conditions that qualify for that class code, and then move back to a previously assigned code. You can see the final verbiage on page 8 of the document.
