Cal/OSHA is Making Changes To Employee Access To The Employers Injury and Illness Prevention Program(IIPP)

Bruce Wick participated in the advisory committee on this issue; and a favorable outcome was achieved. Labor advocates wanted greater access by them, attorneys, and employees to the IIPP.
The changes were approved by the Cal/OSHA Standards Board on January 16, 2020. They are expected to be approved by the Office of Administrative Law, and take effect April 1, 2020. The important points for employers are:
  1. Under subdivision (8)(A), you will see the requirements of a "representative" of an employee to seek access. Make sure they adhere to each point listed.
  2. Under subdivision (8)(B), you will see the options an employer has to provide the requested IIPP. Make sure by April 1, 2020; you provide communication to all employees of their rights, and your procedure for providing the IIPP. This is required by subdivision (8)(E).
  3. A very important point is subdivision (8)(C). The employer is to provide the basic format of their IIPP. They do not have to include copies of investigations, accidents, training, etc.
