About the Seminar:

AB 1513 has created an affirmative defense for employers in California who pay employees on a piece rate pay basis, to resolve issues of paying employees separately for rest periods at piece rate wages, and paying for non-productive time. This affirmative defense allows employers to avoid penalties and fines on top of wages, for prior pay periods. To qualify for the affirmative defense, an employer would need to pay  employees the separate rest period piece rate and at least minimum wage for non-productive time, going back to July 1, 2012. The alternative to calculating the amount is to pay employees retroactively an amount equal to 4% of their wages since the July 1, 2012 date. 


This seminar will provide an overview on the below topics: 

  • Provide a background of how the issue of piece rate pay wages, non-productive  time and rest periods has evolved.
  •  Summarize the bill and how it applies to the construction industry.
  •  Inform attendees of the financial exposure created by AB 1513 combined with SB 588 that creates new mechanisms for the Labor Commissioner’s office to collect back wages.
  •  For those companies doing piece rate or hour + piece rate, explain the ramifications of this new law and what companies need to be doing going forward and what the potential financial impact could be looking back.
