A lawsuit has been filed against the state of California regarding the unfair PAGA (Private Attorneys General Act) from 2004! The lawsuit has been filed by the California Business & Industrial Alliance (CABIA). CALPASC Director of Risk Management has been involved with CABIA for the last year and a half. The employer community needs to provide broad support for this lawsuit, CABIA can’t do it alone. CALPASC is coordinating an effort to support this lawsuit. Bring your other employer friends and suppliers to this meeting.

What is PAGA?

  • PAGA allows an employee to utilize an attorney to file a lawsuit alleging Labor Code or Wage Order violations, with minimal oversight by the state.
  • PAGA penalties are a minimum of $10,000 per employee.
  • A recent case involved employees being paid fully and timely, but with a paystub violation. The PAGA penalties were allowed, resulting in over a million dollars in penalty payments, plus attorney fees.
  • When PAGA was put into law, it was signed by Governor Gray Davis, 5 days after the voters had decided to remove him as Governor, but before he officially left office.
  • The legislative history said it was okay for the state to use “bounty hunter” attorneys to bring these claims, comparing Labor Code violations to hate crime statutes.
  • There are more than 6,000 PAGA suits filed each year, and the number is growing.

  • The politics behind the filing of this lawsuit.
  • The causes of action in the lawsuit.
  • The expected timeline, especially at the appellate court level.

You can be a part of fighting back to have California dissolve or reform the PAGA statutes.
