CA Appellate Hearing On The Pulte v. ASIC

CALPASC's Bruce Wick attended the Appellate Hearing on the Pulte v. ASIC (American Safety Indemnity Company) on July 11, 2017 in San Diego.

 

This case will have important ramifications regarding the obligations of subcontractor insurers under A/I (Additional Insured) endorsements.

 

Pulte brought suit in Superior Court against ASIC regarding several subcontractors A/I coverage. ASIC lost badly, being found in bad faith. The court said ASIC's representative was "not candid" and "very evasive." The court also found that ASIC had a pattern and practice of denying coverage to the Additional Insured, without doing any analysis of each case.

 

Unfortunately ASIC appealed, and the three Justices of Division 1 of the 4th Appellate District heard oral argument on July 11, 2017. They should issue a ruling within 90 days.
