Federal Court in Texas Places Injunction on the Obama Administration's Regulation of Increased Salary for Exempting Employees from Overtime Pay
The regulation increasing the salary from $23,660 to $47,476 for exempt employees was due to take effect December 1, 2016. California's regulation requiring the salary to be two times the minimum wage for a 40 hour week remains in place, approximately $43,680 annually. CALPASC members are reminded that for employees to be exempt from overtime, it is not only the salary requirements that have to be met, but there are key issues regarding actual duties that must be established as well.
