The total proposed penalties between them all are $144,830. CALPASC members should be aware that this level of fines and publicity could result in greater scrutiny by builders regarding fall protection regulations.
CALPASC has been a leader in effective fall protection regulations for over a decade. This is also an important reason CALPASC has been working to keep as much of the California Fall Protection Regulations in place as possible, due to Federal OSHA pushing California to follow Federal regulations. Following is an outline of the penalties levied against KB and the three subcontractors:
KB Home Florida as controlling employer, serious violation, $7,000 fine.
Ezzo Construction, LLC as framing contractor, two serious violations. One for lack of fall protection for 9 foot and 18 foot fall heights, and another for not extending ladders. Total fines were $10,780.
Get In Touch, Inc., dba S. A. Robinson Construction, Inc., was fined for a third repeat violation of fall protection, $69,300 fine.
John Whigham Sheeting, Inc., as framing contractor, for lack of fall protection for 9 foot and 18 foot trigger heights. Whigham had a previous willful/serious violation for fall protection, and the total fine is $53,900.
